9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMETHEUS GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) US $100.
10. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. You and Prometheus Games agree to resolve disputes in the state or federal courts located in Delaware, except where applicable law provides otherwise.
11. Changes
We may update these Terms. Material changes will be announced through the Services. Continued use after changes constitutes acceptance.
